1. Acceptance of These Terms

These Terms of Service ("Terms") are a binding agreement between you and Netcarda LLC ("Netcarda," "we," "us," or "our"). They govern your access to and use of www.netcarda.com, free.netcarda.com, plus.netcarda.com, Netcarda web pages and learning content, browser-based applications, account and checkout pages, paid subscription features, and any other Netcarda service that links to these Terms (collectively, the "Service").

By accessing or using the Service, creating an account, purchasing a subscription, or selecting an "I agree," "accept," or similar control when presented, you agree to these Terms and acknowledge the Netcarda Privacy Policy. If you do not agree, do not use the Service.

Features described as planned, preview, beta, experimental, early access, "coming soon," or similar are not guaranteed to launch, are not part of a present paid entitlement unless Netcarda expressly states otherwise at the time of purchase, and may be changed or withdrawn before release.

2. Eligibility and U.S. Focus

You must be at least 18 years old and legally capable of entering into a binding agreement to use the Service. The Service is intended for adults.

Netcarda is operated from the United States and is presently designed primarily for U.S. users and U.S. credit-card products. We do not represent that the Service is appropriate, available, or legally compliant for use in every jurisdiction. If you access the Service from another jurisdiction, you are responsible for compliance with laws that apply to you.

If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3. What Netcarda Is - and Is Not

Netcarda is an informational and organizational software service designed to help users understand and track credit-card benefits, statement credits, recurring perks, annual fees, reset periods, usage, custom balances, and related information.

Netcarda does not issue credit cards, extend credit, process card transactions, make purchases for you, pay bills, redeem benefits for you, guarantee eligibility for benefits, or control the terms of any card issuer, bank, payment network, merchant, loyalty program, or other third party.

Netcarda is not a bank, lender, credit-card issuer, credit bureau, credit-repair organization, financial adviser, investment adviser, attorney, accountant, or tax adviser. The Service does not provide financial, investment, legal, tax, accounting, credit-repair, or other professional advice.

4. Netcarda Website, Card Library, Learn, Blog, and Editorial Content

Netcarda may publish card pages, comparisons, guides, articles, explanations, calculations, commentary, news, and other editorial or educational content. This content is provided for general informational purposes only.

Credit-card terms can change without notice. Annual fees, statement-credit amounts, enrollment requirements, merchant eligibility, reset schedules, expiration rules, transfer partners, earning rates, offers, and other terms may be changed by the applicable issuer or other third party at any time.

Where Netcarda displays a "reviewed," "updated," "card data reviewed," "editorial review," or similar date, that date means only that Netcarda reviewed or updated the relevant material as of that date. It is not a representation that the information remains current after that date, and it is not a guarantee that every item was complete or error-free on that date.

You are responsible for checking the displayed review or update date and verifying material information directly with the applicable issuer, bank, merchant, payment network, loyalty program, or other official source before applying for a card, making a purchase, canceling or retaining a card, relying on a benefit, or making another financial decision.

Netcarda may correct, revise, remove, or replace editorial and card information at any time. If you notice a possible error or card change, you may report it to Netcarda.

5. Netcarda Free - Local-First Operation

Netcarda Free is currently designed to work without a Netcarda account, payment, bank connection, or card number. You manually select or create cards and record the information you want to track.

Netcarda Free keeps the authoritative copy of user-entered wallet and tracking data on the device you use. Free may temporarily send relevant tracker information to Netcarda to perform calculations and return results. This processing is not used to create an account-based cloud copy of your Free wallet. Netcarda Free does not provide account-based cloud synchronization or server-side recovery merely because you use the Free tracker.

Netcarda Free may provide export and import tools. You are responsible for making and protecting your own backups.

6. Storage, Backups, Synchronization, and Data Loss

Locally stored information may be permanently lost or become inaccessible if you clear browser or site data, delete application data, use certain cleanup or privacy tools, browse in a mode that does not preserve storage, uninstall software, reset or replace a device, lose access to a device, experience hardware or software failure, or encounter corruption or incompatibility.

Netcarda may be unable to recover locally stored Free data because Netcarda does not maintain an account-based recovery copy of your Free wallet. Temporary processing used to calculate Free results does not create a recoverable cloud copy. Export a backup before clearing browser or application data or taking another action that could remove local storage.

You are responsible for the security of your device and exported backup files. Where Netcarda offers password-encrypted portable backups, you are also responsible for remembering and protecting the backup password. Netcarda does not store that backup password and may be unable to decrypt or recover a portable backup if you lose it.

Netcarda Plus stores active tracker data using secure third-party cloud services. Netcarda may also maintain encrypted recovery copies of Plus data for service continuity and limited recovery. Recovery copies are generally subject to a limited lifecycle of up to approximately 30 days from creation, but they may be deleted sooner and are not guaranteed to remain available or be successfully restored. These copies are an additional safeguard, not a promise that every version or item of data can always be recovered.

Plus data may become unavailable, corrupted, overwritten, delayed, or lost because of synchronization conflicts, software defects, maintenance, provider or network failures, device problems, unauthorized access, user actions, imports, resets, account deletion, suspension or termination, or other events. Importing a backup or confirming a reset can replace the current cloud state. Netcarda does not guarantee that a recovery point exists for a particular moment, contains the latest changes, is uncorrupted, or can be successfully restored. Maintain a separate portable backup of information that is important to you.

Deleting a Netcarda account, requesting deletion, or allowing a post-expiration retention period to end may permanently remove the active account and cloud state. Encrypted recovery copies may remain for a limited period under the backup lifecycle before they expire, and those residual copies are not a guarantee that Netcarda can or will restore a deleted account. Creating a new account later, including with the same email address, does not restore previously deleted active cloud data. Export data you want to keep before confirming a reset, import, replacement, or account-deletion action that may be irreversible.

The disclaimers and limitations in Sections 18 and 19 apply to storage, synchronization, backup, and data-loss risks to the maximum extent permitted by law. Nothing in these Terms excludes or limits a right or liability that applicable law does not permit to be excluded or limited.

7. Custom Cards and User Entries

The Service may allow you to create custom cards or balances and enter dates, notes, values, transactions, benefit usage, and other information. You are responsible for the accuracy and legality of information you enter.

Do not enter passwords, bank-login credentials, Social Security numbers, full payment-card numbers, government identification numbers, or other unnecessary highly sensitive information into custom-card fields, notes, support messages, or other free-form fields.

You retain whatever rights you have in information you create or enter. Netcarda does not claim ownership of your locally stored Free tracker data.

8. Netcarda Plus - Accounts, Cloud Sync, and Premium Access

Netcarda Plus is Netcarda's account-based premium service. Plus access may be provided through a paid subscription, trial, promotion, complimentary grant, or other account entitlement made available by Netcarda. Current Plus functionality may include personal and business-card tracking, expanded Custom Cards, account-based cloud synchronization, supported cross-device access, backup and restore tools, and other functionality made available to your account.

Plus requires a Netcarda account. Netcarda uses third-party service providers to support sign-in, account security, hosting, and cloud functionality. Netcarda may store Plus account information and user-entered Plus tracking data so that the data can be associated with your account and synchronized across supported devices.

Complimentary, promotional, or administratively granted Plus access does not by itself create a Stripe subscription, payment obligation, refund right, or promise of indefinite access. Netcarda may limit, modify, or revoke non-paid Plus access, subject to any specific terms presented with that access and applicable law. Paid subscription billing remains governed by Section 10 and the checkout terms.

9. Accounts, Authentication, and Account Security

To use account-based features, you must provide accurate account information and maintain the security of your password, devices, and account. You must promptly notify Netcarda if you reasonably suspect unauthorized access.

Netcarda uses third-party service providers to support account registration, sign-in, verification, password recovery, session security, and transactional email delivery. These services may be used to send verification codes, password-reset messages, security notices, billing or subscription notices, deletion or retention notices, and other account communications.

By maintaining an account, you agree that Netcarda may send non-marketing electronic communications reasonably necessary to operate, secure, bill, or administer the Service. You are responsible for maintaining access to the email address associated with your account. This paragraph does not by itself enroll you in promotional marketing email.

Netcarda support will not ask you to disclose your Netcarda password, full payment-card number, card security code (CVV/CVC), bank-login password, or a one-time verification or password-reset code for the purpose of proving your identity. Enter one-time codes only in the official Netcarda authentication flow for the purpose stated when the code was issued.

Email changes and recovery from loss of access to a registered email may require support and reasonable verification of account ownership. Netcarda may decline or limit an account transfer or recovery request when ownership cannot be reasonably verified, and account recovery is not guaranteed in every circumstance.

You may not access another person's account without authorization, share access in a manner that defeats plan limits or security controls, or attempt to bypass authentication, authorization, rate limits, storage limits, or other safeguards.

Account, authentication, email-delivery, and cloud services depend in part on third-party infrastructure and may occasionally be delayed, interrupted, or unavailable.

10. Paid Subscriptions, Billing, Cancellation, and Refunds

This section applies to paid Netcarda Plus subscriptions. Complimentary, promotional, trial, or administratively granted access that does not involve a purchase is not a paid subscription unless the specific offer states otherwise. For paid subscriptions, the price, billing interval, included features, and any promotional terms displayed at checkout at the time of purchase form part of your subscription terms.

Prices may differ by billing channel, platform or app marketplace, geography, taxes, fees, promotions, currency, or other commercial factors. Netcarda does not guarantee price parity or retroactive price matching among the website, an app store, or another sales channel. The price, billing interval, renewal terms, and taxes or fees shown at the point of purchase control that transaction, subject to applicable law.

Unless checkout expressly states otherwise, a recurring subscription automatically renews for the applicable billing interval at the renewal price disclosed for that billing channel until canceled. You authorize Netcarda and the applicable payment processor or marketplace to charge the payment method you provide for recurring subscription charges, applicable taxes, and other amounts disclosed at checkout.

You are responsible for canceling before a renewal if you do not want the next recurring charge. Forgetting to cancel, failing to use the Service, or failing to notice a renewal date does not by itself create a right to a refund. Cancellation ordinarily prevents future renewals and does not retroactively refund charges already incurred.

Unless otherwise stated at checkout or required by applicable law, you ordinarily retain paid Plus access through the end of the then-current prepaid billing period after cancellation. Netcarda provides customer-facing cancellation through the account and billing experience, including Stripe-hosted billing controls where available. Account deletion is a separate action and is intended to cancel future subscription renewal as part of the deletion process. After paid access expires, Netcarda may restrict the account and begin the account/data-retention and deletion process described in these Terms and the Privacy Policy.

When Netcarda offers a change between billing intervals, the account interface may schedule that change to take effect after the current prepaid period rather than immediately. The timing and price displayed when you request the change control, and a scheduled change may be cancelable before it takes effect where the Service provides that option.

Subscription fees and other payments are generally non-refundable except where required by applicable law or expressly agreed by Netcarda. Netcarda may, in its discretion and subject to applicable law, issue a full or partial refund, credit, or billing adjustment in exceptional circumstances, including a confirmed duplicate charge, a billing error attributable to Netcarda, or another circumstance Netcarda determines warrants an adjustment. A refund or adjustment in one instance does not obligate Netcarda to provide the same remedy in another instance.

If you believe you were charged incorrectly, contact contact@netcarda.com with sufficient information for us to investigate the charge. Refunds for purchases made through an app store or other third-party marketplace may be governed and processed by that provider under its applicable policies.

If Netcarda offers a trial, promotion, refund window, or other special term, the specific terms presented with that offer control. Netcarda may change prices for new purchases at any time. Changes to the price of an existing recurring subscription will apply prospectively, ordinarily no earlier than a future renewal or billing period, and Netcarda will provide advance notice or obtain consent when required by applicable law, payment-platform rules, or the applicable billing channel. A price change does not retroactively reprice a prepaid period already purchased.

11. Payment Processing

Netcarda currently uses Stripe as its third-party payment processor for live paid checkout and subscription billing. Payment processing is subject to Stripe’s applicable terms and privacy practices. If Netcarda changes payment processors, Netcarda will update its disclosures as appropriate.

Netcarda Free does not require payment-card information. When Stripe-hosted or Stripe-enabled checkout is used, payment information may be provided directly to Stripe. Netcarda may receive transaction and subscription information needed to confirm payment, provision Plus access, manage renewals and cancellations, investigate billing issues, prevent fraud, issue permitted refunds or credits, and maintain accounting and legal records.

Netcarda does not intend to store full payment-card numbers or card security codes on Netcarda systems when those details are handled by the payment processor.

Netcarda is not responsible for outages, declines, holds, disputes, authentication requirements, or other acts of a bank, card issuer, payment network, app store, or payment processor, except to the extent applicable law provides otherwise.

12. Third-Party Names, Trademarks, Card Art, and Services

American Express, Chase, Capital One, Citi, Bank of America, Wells Fargo, and all other issuer, bank, payment-network, merchant, loyalty-program, and third-party names, card and product names, trademarks, service marks, logos, card designs, and product imagery are the property of their respective owners.

Netcarda is an independent service and, unless expressly stated, is not affiliated with, endorsed by, sponsored by, authorized by, or officially associated with any card issuer, bank, payment network, merchant, loyalty program, or other third party. Third-party names, marks, card designs, and product imagery are displayed for identification, informational, comparison, commentary, or educational purposes. The inclusion of a product or mark does not mean its owner has reviewed, verified, approved, sponsored, or endorsed Netcarda or the accuracy of information presented by Netcarda.

Image and information sources may be credited where applicable. Attribution or identification of a source does not itself represent that Netcarda owns the third-party material or that attribution alone creates a license; third-party materials remain subject to applicable intellectual-property rights and any permissions or licenses that apply.

Apple, the Apple logo, App Store, and related Apple marks are trademarks of Apple Inc. Google Play and the Google Play logo are trademarks of Google LLC. Official store badges, if displayed, remain subject to the applicable owner's brand-use requirements.

The Service may also rely on third-party infrastructure and services, including AWS for cloud and authentication-related functionality, Resend for transactional email delivery, and Stripe for payment processing. Those providers operate under their own terms and privacy practices.

13. Limited License and Acceptable Use

Subject to these Terms, Netcarda grants you a limited, personal, revocable, non-exclusive, non-transferable, and non-sublicensable license to access and use the Service for lawful purposes.

Except where applicable law expressly permits otherwise, you may not sell, rent, sublicense, or commercially exploit the Service; copy or redistribute substantial portions of the Service or card database; bypass or defeat authentication, authorization, subscription or entitlement checks, rate limits, storage limits, or other safeguards; alter client code, network requests, files, or application behavior to obtain unauthorized access or paid functionality; probe for or exploit vulnerabilities; introduce malicious code; interfere with operation of the Service; gain unauthorized access to another account, administrative function, or system; use bots or scrapers to extract substantial content or overload the Service; use Netcarda cloud sync as unrelated general-purpose file storage; intentionally create excessive, redundant, malformed, or artificial data to consume storage or computing resources; impersonate another person; evade a suspension or termination through replacement accounts, alternate identities, or changed network information; or reverse engineer, decompile, or disassemble downloadable software except where applicable law expressly permits it.

Netcarda may investigate suspected violations and use reasonable technical or administrative measures to protect and enforce the Service, including rate limiting, revoking sessions, disabling or restricting accounts, blocking abusive requests or network traffic, or other proportionate controls. Netcarda does not promise that any particular enforcement method, such as an IP-address block, will be used in every case.

14. Intellectual Property and Feedback

The Service and its original software, text, graphics, interfaces, branding, selection and arrangement of content, and other original materials are owned by Netcarda or its licensors to the extent protected by copyright, trademark, trade-secret, or other applicable law.

Netcarda™ and associated Netcarda branding are trademarks or claimed trademarks of Netcarda LLC. Third-party materials remain the property of their respective owners.

If you voluntarily submit ideas, feature requests, suggestions, bug reports, or other feedback, you grant Netcarda permission to use that feedback to operate, develop, improve, and promote the Service without compensation or obligation to you. This does not transfer ownership of unrelated materials or personal information.

15. Accuracy, Calculations, Scores, Reminders, and No Reliance

Calculations, scores, annual-value estimates, effective annual-fee figures, reminders, expiration indicators, streaks, comparisons, recommendations, and other outputs depend on available information, user entries, assumptions, device dates, and software logic. They may be inaccurate, incomplete, delayed, or unsuitable for your circumstances.

Only enter a statement credit as received when it has actually posted if that is what the feature instructs. Netcarda does not independently verify every user entry or every issuer event.

You remain responsible for monitoring your accounts, statements, fees, payment due dates, benefit eligibility, enrollment requirements, expiration dates, and issuer communications. Where Netcarda provides reminders, email, push notifications, calendars, or similar alerts, delivery may be delayed, blocked, misconfigured, filtered, or unavailable, and you should not rely on a Netcarda notification as your sole means of meeting a deadline or using a benefit.

16. Changes to the Service; Beta and Planned Features

Any portion of Netcarda that is expressly labeled beta, prototype, preview, experimental, early access, sandbox, or similar may contain bugs, lose data, change materially, or stop working.

Netcarda is an evolving service. To the maximum extent permitted by applicable law, Netcarda may add, modify, replace, restrict, suspend, or discontinue features, functionality, integrations, supported cards, supported platforms, storage methods, account requirements, usage or storage limits, service tiers, free or paid offerings, or other aspects of the Service. Netcarda may also change how Free or editorial portions of the Service are monetized, including by introducing advertising, provided that Netcarda updates privacy disclosures or consent controls when a change materially affects personal-data practices.

A feature available at one time is not guaranteed to remain available indefinitely. Features identified as planned, preview, beta, experimental, "coming soon," roadmap, or similar may be changed, delayed, replaced, or never launched. Unless Netcarda expressly states otherwise at the time of purchase, purchase a paid subscription based on the features currently available to you rather than a planned feature.

For a prepaid paid-subscription period, Netcarda will handle material service or pricing changes in accordance with the checkout terms, applicable law, and any non-waivable consumer rights. This section does not permit Netcarda to avoid a remedy that applicable law requires.

17. Privacy; Cookies, Local Storage, and Service Technologies

The Netcarda Privacy Policy explains how Netcarda handles information and is incorporated by reference into these Terms.

Netcarda may use browser or application storage, strictly necessary cookies, and similar technologies to keep Free tracker data on your device, remember preferences, support sign-in, protect account sessions, and provide requested Service functionality.

Third-party service providers used for authentication, transactional email, payment processing, cloud hosting, security, and related functions may process information as described in the Privacy Policy and their own applicable policies.

18. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS. NETCARDA DISCLAIMS WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, SECURITY, ERROR-FREE OPERATION, CONTINUOUS CLOUD STORAGE OR SYNCHRONIZATION, SUCCESSFUL BACKUP OR RESTORATION, NOTIFICATION DELIVERY, AND RECOVERABILITY OF DATA.

NETCARDA DOES NOT WARRANT THAT CARD INFORMATION, BENEFIT INFORMATION, CALCULATIONS, SCORES, REMINDERS, EDITORIAL CONTENT, OR OTHER OUTPUT WILL BE COMPLETE, CURRENT, ACCURATE, AVAILABLE, OR SUITABLE FOR YOUR PARTICULAR CIRCUMSTANCES.

Some jurisdictions do not allow certain warranty exclusions, so some exclusions may not apply to you.

19. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NETCARDA LLC AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST SAVINGS, LOST DATA, LOST BENEFITS OR CREDITS, BUSINESS INTERRUPTION, OR LOSS OF GOODWILL, ARISING OUT OF OR RELATING TO THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NETCARDA'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) US $100 OR (B) THE AMOUNT YOU PAID NETCARDA FOR THE SERVICE DURING THE TWELVE MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

These limitations do not exclude or limit liability that cannot lawfully be excluded or limited.

20. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Netcarda LLC and its owners, officers, employees, contractors, and agents from third-party claims, liabilities, damages, and reasonable costs arising from your unlawful misuse of the Service, your material violation of these Terms, or your infringement of another person's rights. This section does not require indemnification for Netcarda's own conduct where prohibited by law.

21. Suspension, Subscription Expiration, Termination, and Account Deletion

You may stop using the Service at any time. Deleting local browser or application data may permanently delete locally stored Free information.

Netcarda may suspend, restrict, or terminate an account or access to the Service for material violations of these Terms, fraud, abuse, security threats, unlawful activity, nonpayment, attempts to circumvent plan or storage limits, misuse of Netcarda infrastructure, or where reasonably necessary to protect Netcarda, users, or third parties.

Authorized Netcarda personnel may access account information and, when reasonably necessary for support, security, abuse investigation, recovery, legal compliance, account administration, or deletion, Plus cloud data or recovery materials. Sensitive access is restricted to authorized purposes and may be recorded in audit logs. These capabilities do not guarantee that Netcarda can recover particular data and do not alter the separate local-first architecture of Netcarda Free.

If a paid Plus subscription ends and is not renewed, Netcarda may restrict paid Plus access at the end of the prepaid period. Under Netcarda's current implementation, the associated Plus account and active cloud data are ordinarily scheduled for deletion fourteen (14) days after paid access ends, unless the account has another active entitlement, a different period is disclosed in the Service, retention is reasonably necessary for security, fraud prevention, legal, tax, accounting, dispute, or backup purposes, or applicable law requires otherwise. Encrypted recovery copies may remain for a limited period after active data is deleted and are generally kept for no more than approximately 30 days from creation, but they may be deleted sooner and are not guaranteed to remain available or recoverable.

Where Netcarda provides an account-deletion function, follow the disclosures shown in that flow carefully and export data you want to keep before confirming deletion. Under the current direct-billing flow, customer-requested account deletion cancels an active Stripe subscription, stops future renewal charges, removes the authentication identity and active Plus cloud data, and may be irreversible. Residual encrypted recovery copies, audit records, billing records, or legally required records may remain for the limited periods described in the Privacy Policy. Unless expressly stated or required by law, deleting an account does not automatically create a refund for prior subscription charges.

Netcarda may temporarily suspend or restrict access while investigating suspected fraud, abuse, security threats, or serious Terms violations. A temporary access restriction does not necessarily cancel an existing paid subscription or payment record. If Netcarda permanently terminates paid Plus access, Netcarda will cancel future subscription renewal or otherwise take reasonable steps to prevent additional recurring charges for the terminated access. Netcarda will address any charge already incurred, unused prepaid access, refund, credit, or other billing consequence in accordance with these Terms, applicable law, and the circumstances of the termination.

Provisions that by their nature should survive termination, including intellectual-property provisions, disclaimers, limitations of liability, payment obligations already incurred, and dispute provisions, survive.

22. Governing Law and Disputes

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles, except to the extent another jurisdiction's law must apply.

Unless applicable law requires otherwise, court proceedings arising out of these Terms or the Service must be brought in a state or federal court with jurisdiction in Denton County, Texas, and you and Netcarda consent to personal jurisdiction and venue there.

These Terms do not require binding arbitration or waive class-action rights.

Nothing in these Terms limits a non-waivable consumer right or remedy.

23. Changes to These Terms

Netcarda may update these Terms as the Service, business model, technology, or law changes. The current version will display an effective or last-updated date.

If a change is material, Netcarda may provide additional notice through the Service, account interface, checkout, or email where reasonably appropriate or legally required. If a material change requires affirmative consent, Netcarda will request it.

Your continued use after revised Terms become effective constitutes acceptance to the extent permitted by law. If you do not agree to revised Terms, stop using the affected Service.

24. General Terms

If any provision is held unenforceable, the remaining provisions remain effective to the fullest extent permitted by law. Failure to enforce a provision is not a waiver.

You may not assign these Terms without Netcarda's consent. Netcarda may assign them in connection with a merger, reorganization, financing, sale of assets, or similar transaction, subject to applicable law.

These Terms, the Privacy Policy, and any additional terms expressly presented for a particular feature or transaction constitute the agreement between you and Netcarda regarding the Service.
